Customers who create an account and use MOAI’s services (“Customers”), and
End users or contacts who interact with a Customer’s configured assistant through integrated third-party platforms (such as social networks or messaging services).
By accessing or using the Platform, you acknowledge that your personal data will be processed in accordance with this Privacy Policy.
2. Roles and Responsibilities in Data Processing
2.1 MOAI as Data Processor
MOAI acts exclusively as a data processor (data handler) with respect to personal data processed on behalf of its Customers, particularly data originating from third-party integrations (such as messages, comments, or leads).
MOAI processes such data solely under the instructions of the Customer, who remains the data controller (data owner) and is responsible for determining the purposes and legal bases of processing.
2.2 Customer Responsibilities
Customers are solely responsible for:
Ensuring that their use of the Platform complies with applicable data protection laws;
Informing end users about the processing of their data;
Obtaining any required consents from end users.
3. Personal Data We Process
3.1 Customer Account Data
MOAI may process the following data from Customers:
Identification and contact information (name, email address);
Authentication credentials (stored in encrypted form);
Company or project information;
Subscription, billing, and payment-related information;
Technical and administrative communications.
3.2 Operational and Usage Data
Assistant configuration data (workflows, automation rules, scripts, and knowledge bases uploaded by the Customer);
Platform usage data (log records, timestamps, IP addresses, browser type, and interaction data within the dashboard).
3.3 End-User and Lead Data (Processed on Behalf of Customers)
Depending on the Customer’s configuration and integrations, MOAI may process:
Messages, comments, and interactions from third-party platforms;
Public profile data made available by such platforms;
Contact or lead-related information generated through interactions.
MOAI does not determine the content or purpose of such data and processes it only as instructed by the Customer.
4. Purposes of Processing
MOAI processes personal data solely for the following purposes:
Providing, operating, and maintaining the Platform and its functionalities;
Enabling automation, unified messaging, and assistant responses as configured by the Customer;
Managing accounts, subscriptions, and billing;
Ensuring platform security, integrity, and abuse prevention;
Performing internal analytics and service improvements using aggregated or anonymized data only.
MOAI does not use Customer or end-user data to train artificial intelligence models.
5. Artificial Intelligence and Data Usage
MOAI does not use conversations, messages, or personal data processed through the Platform to train, fine-tune, or improve artificial intelligence models.
Any internal analysis is performed exclusively on anonymized and aggregated data and cannot be used to identify individuals.
6. Data Retention and Deletion
Personal data is retained only for as long as necessary to provide the services or as configured by the Customer.
Customers may request deletion of their data at any time.
Upon account closure, personal data is deleted without undue delay, except where retention is required by applicable law (e.g., accounting, tax, or legal obligations).
MOAI does not maintain backups containing conversation data once deletion has been completed.
7. International Data Transfers
MOAI’s infrastructure and service providers may be located in the United States or other jurisdictions.
Where international transfers occur, MOAI applies appropriate safeguards to protect personal data in accordance with applicable data protection standards.
8. Cookies and Tracking Technologies
MOAI uses cookies and similar technologies on its website and Platform.
8.1 Types of Cookies
Essential cookies: Necessary for platform functionality and security.
Analytics and measurement cookies: Used to analyze usage and improve performance.

The Platform’s available account management tools.
MOAI will respond to valid requests within a reasonable timeframe, not exceeding 30 calendar days.
For any other rights (such as access, rectification, or objection), data subjects must contact the relevant Customer acting as data controller.
12. Children’s Data
The Platform is not intended for use by minors.
If MOAI becomes aware that personal data of a minor has been processed inadvertently, such data will be promptly deleted.
13. Changes to This Policy
MOAI may update this Privacy Policy from time to time. Material changes will be communicated through the Platform or by other appropriate means.
